Confies submits proposal to modernize the “Law of the Support Foundations” to the Chamber - Fiotec

The National Council for Foundations Supporting Higher Education and Scientific and Technological Research Institutions (Confies), represented by its president Antônio Fernando Queiroz, submitted the base-text for a bill aiming to update and modernize the so-called Law of the Support Foundations (Law no. 8.958/1994) to congresswoman Luisa Canziani (PSD/PR). The standardization governs the relationships between foundations, federal higher education institutions (Ifes) and institutions of scientific and technological research.

It is understood that the current law, which is about to turn 30 years old, must be updated to further assist in the de-bureaucratization of scientific and technological activities and face new science challenges after the pandemic.

“The current law defines a very limited acting scope for the foundations, presenting outdated procurement rules, which directly interfere in the agility of the service provided, in addition to being an unsettled standard, that has undergone several changes,” explains Marianna Magalhães, legal manager at Fiotec and member of the Confies College of Attorneys, who participated in the submission of the draft to the congresswoman on the last Tuesday (8/22). According to the attorney, a new law would set clearer rules for taxes on grants, ensure more flexibility in the procurement processes and, consequently, a broader scope to supporting foundations.
